B. EMPLOYMENT ( continued )

b. Part Time

An employee who has successfully completed his or her Introductory/Orientation Period and who has been hired as part-time is not eligible for benefits described in this Employee Handbook with the following exception: if an employee works 39 hours or more in either week of a two week pay period, but fails to work 78 hours or more in the total two week pay period, the employee will qualify for paid time off (PDO) at the rate discussed herein.

c. Per Diem

Per Diem employees are those employed for “as needed” assignments and may include, but are not limited to, RN’s and LPN’s. “As needed” assignments generally are scheduled to cover vacations and illnesses. Per Diem employees are not eligible for employee benefits.

d. Non-Exempt and Exempt Employees

At the time of hire, employees are classified as either “exempt” or “non-exempt.” This is necessary because, by law, employees in certain types of jobs are entitled to overtime pay for hours worked in excess of hours designated by government. These employees are referred to as “non-exempt” in this Employee Handbook. This means that they are not exempt from (and therefore should receive) overtime pay.

Exempt employees are managers, executives, professional staff, technical staff, outside sales representatives, officers and others whose duties and responsibilities allow them to be “exempt” from overtime pay provisions as provided by the Federal Fair Labor Standards Act (FLSA) and any applicable state laws. At the time of hire, transfer or promotion, employees will be advised that they are in this classification.
